DIVORCE:
In the state of North Carolina a married couple must be separated for one year before a request for a divorce can be made. This means the couple must live under two separate roofs continuously for one year, with the intent by at least one spouse to end the marriage. It is critical to either fully resolve property distribution or to ask the court to resolve property distribution before the divorce is granted.
SEPARATION:
A Separation Agreement is a legal contract between a Husband and Wife resolving issues such as property distribution, custody, child support and spousal support. A Separation Agreement must be notarized.
